Agreement to Terms

By accessing or using gemreptiles.com (the "Site"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Site.

Permitted Use

The Site is provided for lawful personal use. You may browse publicly available listings, submit inquiries about animals, and create an account to purchase and/or keep track your previously purchased animals.

Fair use of publicly visible Site content — such as linking to listings, quoting short excerpts for commentary or review, and personal non-commercial reference — is permitted under applicable law.

Prohibited Use

You may not use the Site to:

  • Facilitate the illegal sale, transport, or possession of any animal or product
  • Violate any applicable local, state, federal, or international law or regulation, including CITES and wildlife trafficking prohibitions
  • Submit false, misleading, or fraudulent information
  • Harass, threaten, or harm any user or seller
  • Scrape, harvest, or systematically collect Site content by automated means for redistribution or commercial purposes without written permission
  • Use Site content, images, descriptions, or data — in whole or in part — as training data, fine-tuning data, evaluation data, or any other input for artificial intelligence or machine learning models, systems, or products, for any purpose, by any individual, organization, or entity other than Gem Reptiles

Intellectual Property

All content published on this Site — including but not limited to photographs, videos, written descriptions, animal names, logos, and graphic design — is the property of Gem Reptiles and is protected by copyright law.

No content may be reproduced, distributed, publicly displayed, or used to create derivative works without prior written consent from Gem Reptiles, except as expressly permitted by applicable fair use provisions.

The prohibition on AI training data use (above) applies regardless of whether such use would otherwise qualify as fair use under copyright law.

Indemnification

You agree to indemnify, defend, and hold harmless Gem Reptiles, its owners, operators, and contributors from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the Site in violation of these Terms
  • Your violation of any applicable law or third-party right
  • Any content you submit, post, or transmit through the Site
  • Any transaction you enter into as a result of using the Site

Disclaimer of Warranties

The Site is provided "as is" without warranties of any kind, express or implied. Gem Reptiles does not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the fullest extent permitted by law, Gem Reptiles shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site or any content or services provided through it.

Changes to These Terms

We reserve the right to modify these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
